The governor is not being sued in as an individual. The policeman in question, Martin Escobar, wants local law enforcement to be exempt from enforcing the law, saying it racially profiles. He is a Mexican who became a naturalized U.S. citizen.

Since (non-gang) serial killers often tend to be white, maybe they do not want murder laws enforced either, because it would be racial profiling.

That's not true. The list of non-White serial killers goes around the corner. Wayne Williams, David Berkowitz, Richard Ramirez, John Allen Muhammad, Lee Malvo, Harrison Graham to name a few of the better known ones. It so happens America has historically been a mostly White country, thus it made sense most serial killers were White. That is indeed changing.
